I got found the driver on Intels website and it a BSD license. The driver I found is a bit newer that the one in FreeBSD but I would guess they have the same license... The driver can be found at ftp://aiedownload.intel.com/df-support/4105/eng/em-1.4.10.tar.gz I guess it would be a good idea to include the LICENSE file in the FreeBSD tree since the README refers to it, but the license is actually in the source files so I guess it is not that important.
