My suspicion is that this also prevents us from modifying COPYRIGHT and still distributing these files without specific permission. This would be because we presumably can't change the license terms as non-copyright holders, and changing the COPYRIGHT file would change the license terms. An explicit license makes things much easier for everyone, since it means the files can be easily inspected to determine their license. Given that one of the things we encourage people to do is take FreeBSD and put it into other products, making life easier for them is highly desirable.
