Read the license that appears in every file of the kernel source. "Do what you want, but leave this notice". I.e. the Regents keep their rights. Later additions after the UCB gave up BSD are under similar terms. I'm no lawyer, but what you want to do doesn't require any one's permission, or any particular later obligations. This isn't Linux.
