Linux is licensed under a variant of the GPL that allows the linking 
of modules and libraries that are not GPLed. This does not apply at
all to this case, in which the module WOULD be GPLed. 

There should NEVER be any GPLed kernel module for FreeBSD. As far
as I'm concerned, IBM wrote off any chance of having JFS ported to
anything other than Linux when it GPLed it. It was a horrible decision.
