I think we can expect that they have a whole source tree. "That file doesn't apply because it's not part of the kernel" seems like a legal technicality to me, common sense would suggest that it applies to everything. That said, I don't think it will do anything to stop certain committers from running roughshod over code with a MAINTAINER.
