Optional parts of the kernel and required parts of the development utilities (compiler, for example) are covered by the Gnu public licence and so when you distribute those you follow the terms of their copyright in addition to the terms of the Berkeley copyright on the mandatory parts of the kernel. Try searching the FreeBSD mailing lists using the keyword "commercial".
