It seems to have a proper license GPLv2 and is distributable. It looks like it's simply broken because it does not compile probably due to the switch to a C++11. I've opened an issue on Bugzilla for this.[1] It seems to require some minor fixes but I don't have time for this unfortunatelly at the moment. You may look at those errors on your own. Just download the ports[2] and then run # cd /usr/ports/x11-wm/icewm # make If you would like to work on this issue and write some patches then I'm ready to assist you.
