Are you sure you're not missing something else here?

theater:[vs]> locate /time.h
/usr/include/sys/time.h
/usr/include/time.h
theater:[vs]> uname -a
FreeBSD theater.foldr.org 4.8-STABLE FreeBSD 4.8-STABLE #0: Sun Aug 17 17:17:06 CEST 2003     root@monster.theater.foldr.org:/opt/obj/opt/src/sys/GATE  i386

What's the error message when you try to build it? Can you use pkg_add -r 9e
to install the package?
