Did you consider trying to plead with the author for an alternate
copyright, ala PERL with its GPL and "Artistic" copyrights?

I think a fair bit of work was put into converting it from a DOS
screen I/O paradigm to an ncurses one, and I doubt you'd want to
redo it!
