Wether Tru64 actually has any of this code in it is another matter. It's probably cheaper for Compaq to pay the royalties instead of going to court to prove it doesn't use AT&T's code. Most of the money in the $99 price goes to pay royalties for such code. It would be a monetary loss for Compaq to give Tru64 away because for every copy they give away they would have to pay the royalties out of their own pocket.
