The Intellectual Property (Miscellaneous Amendment) Ordinance 2000 will commence on 1 April 2001. It amends the relevant intellectual property laws to prevent bootlegging of copyright works and to facilitate prosecution of corporate copyright piracy activities, with a view to enhancing the protection of intellectual property rights in Hong Kong.

The use of copyright infringing products in business (e.g. pirated computer software and music or video compact discs) is a serious problem in Hong Kong. According to one unofficial estimate, about 50% of all computer software used in business is pirated software. Such an excessive degree of violation of intellectual property rights has significantly affected the legitimate interests of copyright owners, discouraged innovation and investments, and tarnished the international image of Hong Kong.

The existing Copyright Ordinance already provides for criminal sanctions against corporate copyright piracy activities. Under the Ordinance, a person commits an offence, if he, without the licence of the copyright owner, possesses an infringing copy of a copyright work "for the purpose of trade or business" with a view to committing any act infringing the copyright. However, it is not absolutely clear whether this provision applies to the situation where the "trade or business" in question does not consist of selling or dealing in the infringing copy itself. To put this matter beyond doubt, the amended law clarifies the Copyright Ordinance by providing that people who possess infringing copies of copyright works in the course of, in connection with, or for the purpose of their trade or business, with a view to committing any act infringing the copyright, will commit an offence. The offence is committed even if they do not sell or deal in the infringing copies themselves.

If your employee incurs civil liabilities in the course of employment, you may be vicariously liable as his employer. 
If your employee commits a criminal offence under the amended law, you may also be prosecuted if you know or has reason to believe that the software in question is an infringing copy.

The maximum penalty remains to be a fine of $50,000 per infringing copy and 4 years' imprisonment. As before the amendment, Customs officers have power to seize and forfeit suspected infringing copies and other things which may be evidence of commission of an offence, whether or not a charge has been laid. 
The remedies available to the copyright owners for copyright infringement remain the same. The remedies include injunction, an order for delivery up of the infringing copies, damages and an account of profits made
