There *is* a problem with the code, which is discussed recently in FreeBSD-users-jp mailing list (in Japanese). The flags 0x31 should mean "Statclock is broken, and Limit APM protocol to 1.1 or 1.0". Thus even with flags 0x31 one should be able to power off using APM protocol 1.1. What really happens is that apm_driver_version is never called in apmattach (pointed out by Hideaki Okada in [FreeBSD-users-jp 40205] <199903260948.SAA21263@jaz.jp.freebsd.org>).
