The short answer: The owners of the Unix trademark (www.opengroup.org, IIRC) control who may refer to their OS as "Unix". The've got a suite of tests and specs which include the need to pay them money both to use the tests and the trademark. The specs include what's referred to as "POSIX" and are sorta open.
