No, they are not "officially" in the public domain.  The first time
they were distributed with an emulator (PC64), the author asked
Commodore (or whoever held the right at those times) for the
permission and received no answer.  So, all the emulator users assume
they can be re-distributed freely.

So basically the exact copyright status is unknown.  We have had a
similiar problem with the Debian distribution, and we the `.deb'
archive is now shipped without any ROMs.  I guess the FreeBSD people
should do the same.
