So long as they don't distribute it linked with the Linux kernel, then it's not a problem. Red Hat, on the other hand, _may_ have a hard time distributing it as the boot file system for Linux, since it would require linking. You can basically link code under any license with code under any other license, so long as the license doesn't prohibit it. The GPL merely prohibits distribution of the post-linkage code under a license other than GPL. For runtime linkage as a Linux kernel module, this is not a problem.
