While it may be free in your understanding, it certainly doesn't
qualify as Open Source
(cf. http://www.opensource.org/docs/definition.html#3).

In my understanding, you are not even allowed to change the
<shudder>/services path of the requisite daemontools</shudder> and
redistribute it; correct me if I'm wrong.
