They shouldn't be. From sysctl(8),

     Name                            Type          Changeable
     ...                             ...           ...
     kern.maxproc                    integer       no

And if we go to the code,

  $ grep -w maxproc /usr/src/sys/kern/kern_mib.c
  SYSCTL_INT(_kern, KERN_MAXPROC, maxproc, CTLFLAG_RD, 
      &maxproc, 0, "Maximum number of processes");

Note the 'CTLFLAG_RD;' it's read-only.

You need to recompile to change it.
