Is there any chance you could retest this on a recent FreeBSD release, such as 6.3-RELEASE or 7.0-RC2, and let us know if the problem is still there? The root mounting code has been substantially rewritten since 4.9, and it may well be that the problem has been fixed (or replaced with newer and more interesting bugs?)
