Yes, all memory used by the kernel is non-pageable, although changing
this is on the wish-list.

Not as far as I know.

Incidentally, if you haven't already seen it, the guide to writing
FreeBSD device drivers at http://www.freebsd.org/tutorials/ is well
worth reading.
