Please note, I am not a lawyer, and if your business depends on ZFS you 
should contact a competent attorney if you have legal concerns.

Both sides are suing each other, and the _likely_ outcome will be that 
they come to some sort of agreement, which will probably involve 
licensing, and some money changing hands.

The URL below has a pretty good analysis of both the current, and the 
ongoing legal issues around ZFS and WAFL.
