You're updating with CVS, not cvsup, so the question doesn't apply.

Nope.  You have extra files in your ports directory because the attics
were removed from the repo, so CVS thinks they're your files and
doesn't delete them.  Remove them by hand (look for lines in your cvs
update starting with '?').
