My feeling is that it is a shame that is all. As for your scathing comment about the evolution of EXT2, I have no comment since it sounds like opinion rather than fact. As a matter of interest in the new book "Absolute BSD" it states fairly definitely that you can freely use EXT2FS. And I believe the book has the blessing of several key people (I just looked at the names).
