I do not reproduce either problem in poudriere, building all packages from
scratch from a fresh checkout of ports (main) on a 12.3-RELEASE userland in
jails (as built by poudriere; host kernel is a recent 12.3-STABLE).

(As a side note, this made me notice a problem when building using ccache,
which I'm going to fix; a plain build without ccache works.)

So not sure how to proceed from here. Do you have something unusual in your
poudriere configuration? On my side, for this build, I did not have any
'make.conf' nor non-default port options. I only deactivated TMPFS and I'm
building as non-root (in 'poudriere.conf').
