Incidents like this have been handled successfully with this sort of plan
and Judges have found for the plaintifs is these cases. Mainly the cases
have to do with phone and junk snail mail. Here is what needs to happen to
have a chance at success.
If the spamming company is in the U.S. you would need to
send a Certified Letter to that company explaining the details of the
deal.
The Certified Letter, since it must be signed for is your proof that the
mail has been delivered.
Then the letter must state why the charge is being made. In this case I
would explain that this is a professional, non-profit email list, and that
they are more than welcome to spam to it, if they are a sponcer. Then,
make the terms of acceptance of being a sponcer the act of sending spam to
the list.
This notice will also need to be in the sign-up procedure for gaining
access to the list.
Basicly, you are setting up a sponcership from a for profit company to a
non-profit organization.
I would, and I just bet you a dollar there is one lawyer on this list,
find a lawyer to write this up.
