Trying a non setuid version of cu gives the same problem:

-r-xr-xr-x  1 root  group  110592 May 11 17:22 cu

%cu --speed 9600 --line /dev/cue0
cu: open (/dev/cue0): Permission denied
cu: /dev/cue0: Line in use
