I'm probably wrong here, but I could have sworn I read that a judge
recently ruled that port scanning was not harmful to networks, and
therefore not illegal.

If you expose your ass in public, you should expect one or more of the
following. Someone will touch it, slap it, pinch it, or worse... Penetrate
it. So knowing this, we shouldn't expose our asses in public...
