Subject:   via sound card doesnt work

my via sound card doesn't work.  i'm running 4.2 stable.  i've compiled 
sound support into the kernel, ran `sh MAKEDEV snd0`, and the output to 
/dev/sndstat is:

FreeBSD Audio Driver (newpcm) Mar 15 2001 08:46:33
Installed Devices:
pcm0: <VIA VT82C686A> at io 0xdc00 irq5 (1p/1r channels duplex)

when i try to play a file i get the message:
** WARNING **: oss_open(): Failed to open audio device (/dev/dsp): Device 
busy


/dev/dsp does exist.  what can i do from here??
