Even so, if you want to use more than one bpf at a time, you'll have to use MAKEDEV to create bpf1, bpf2, bpf3 .. or at least that's what I had to do here (2.2.6-RELEASE). I didn't discover this for months, till one day I wanted to run tcpdump on two interfaces.
