Looks like this has been fixed.

At least I can't reproduce the issue with a system based on 11-STABLE:

privoxy@privoxy-jail / $sysctl security.jail.jailed
security.jail.jailed: 1
privoxy@privoxy-jail / $procstat -b $(pgrep privoxy)
     PID COMM                 OSREL PATH
72460 privoxy           1100509 /usr/local/sbin/privoxy
