Someone on one of the linux sites, Linux Weekly News (http://lwn.net/)
asked a lawyer this question and got back a "case law not clear on
this" repsonse.  Safest is to wait the extra day, it seems.  It was
posted to the "feedback" page on that site within the last couple of
weeks.
