Yep, it is a GPL'd driver Broadcom makes available to OEMs. See eg: http://www.ee.surrey.ac.uk/Personal/G.Wilford/Inspiron8500/#Ethernet_-_Broadcom_4401_4401:1028_ Version 2.0.0 seems to have a reasonably clean separation between OS-specific and OS-independent stuff.
