It's fixed in RELENG_7 as far as I'm aware:

http://www.freebsd.org/cgi/cvsweb.cgi/src/sys/netinet/tcp_output.c#rev1.141.2.5

but there was talk of it being an errata candidate for RELENG_7_0, which 
doesn't look like has happened just yet.
